The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.
Why this matters: Depositing cash into the ledger early does not protect you from interest — the GSTR-3B must actually be filed on time.
GSTN Advisory, 2021 — negative liability appearing in Form GSTR-4 filed by composition taxpayers · 2021
Composition taxpayers who left Table 6 of the annual return GSTR-4 blank found that the tax already paid through Form CMP-08 was treated as an excess payment, creating a negative liability that was then adjusted against later quarters. GSTN clarified that outward supply and reverse charge figures must be entered in Table 6 even though the tax has already been paid, and arranged for wrongly created negative balances to be reversed.
What it means for you: Composition dealers in Chennai must complete Table 6 of GSTR-4 each year, or the portal will show a false credit and later recover it.
Notification No. 14/2022-Central Tax · 2022-07-05
The Central Goods and Services Tax (Amendment) Rules, 2022 inserted Rule 88B, which prescribes the manner of computing interest on delayed payment of tax and on wrongly availed and utilised credit, giving statutory form to the net cash liability principle. The notification also revised Table 4 of Form GSTR-3B so that gross credit, permanent reversals and temporary reversals are reported separately, and permitted payment of tax through unified payments interface and immediate payment service.
What it means for you: From the July 2022 return onwards, a Chennai business must report reversals correctly in the revised Table 4, since the department reconciles that table directly against GSTR-2B.
