Input tax credit of about Rs 8.21 lakh for 2017-18 and Rs 3.53 lakh for 2018-19 was denied because of mismatches between the suppliers' GSTR-1 and the recipient's GSTR-2A. The Court declined to interfere in writ jurisdiction, holding that where suppliers do not act on requests to correct their returns the credit availed is liable to be repaid, and that the appropriate remedy is a statutory appeal under Section 107. Thirty days were given to file the appeal.

Practical effect: Chennai buyers should chase suppliers to amend GSTR-1 within the statutory window; once an assessment order is passed, the High Court will usually push the matter to appeal.

At what amount of tax evasion can GST prosecution be launched?

Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues.
