An advertising agency was charged value added tax on the entire consideration although service tax had already been paid on the design element. The Supreme Court held that payments of service tax and of value added tax are mutually exclusive, so in a composite contract the value attributable to the service component cannot also be subjected to sales tax, and the two levies must attach to distinct parts of the transaction. Double taxation of the same value is impermissible.

What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. If a challan expires unpaid, simply generate a fresh one; no consequence follows. Payment modes include net banking, UPI, cards, NEFT or RTGS, and over-the-counter deposit up to Rs.10,000 per challan per tax period.
I generate e-invoices. Do I still have to prepare GSTR-1 separately?
If your aggregate turnover exceeds Rs.5 crore, e-invoicing is mandatory and the invoice details reported to the Invoice Registration Portal auto-populate into your GSTR-1. However, auto-population is not a substitute for review. B2C sales, exports without IRN issues, credit notes, amendments and advances still need to be verified or added manually before submission. How does an ISD actually distribute credit among branches?
Distribution follows Section 20 read with Rule 39. Credit attributable to a single branch goes only to that branch; credit for common services is distributed among operational branches in the ratio of their turnover in the preceding financial year. The ISD issues an ISD invoice to each recipient GSTIN and reports the distribution in GSTR-6 by the 13th of the following month, after which the credit appears in each branch's GSTR-2B. IGST credit is distributed as IGST, while CGST and SGST credit is distributed as IGST to branches in other states. Excess distribution is recoverable from the recipient with interest, so the turnover ratios must be computed carefully each year.
How are B2B and B2C invoices reported differently in GST returns?
B2B invoices, meaning supplies to registered buyers, are reported invoice by invoice in Table 4 of GSTR-1 with the buyer's GSTIN, so each one flows into that buyer's GSTR-2B for credit. B2C supplies are split into two streams: large inter-state invoices above the threshold are reported invoice-wise in Table 5, while all remaining B2C sales are reported as consolidated, rate-wise totals per state in Table 7. This is why capturing the buyer's GSTIN correctly at billing matters so much; an invoice keyed as B2C by a cashier gives the registered buyer no credit and triggers correction requests later.
Can my company claim ITC on GST paid to a contractor building our new office?
Generally no. Section 17(5) blocks input tax credit on works contract services and on goods or services used for construction of immovable property on your own account, even when the building is used for business. The exception is plant and machinery, so credit on GST paid for installing machinery, equipment or apparatus fixed to earth remains available. The block does not apply within the construction chain itself: a sub-contractor's works contract service supplied to the main contractor is creditable for the main contractor, since it is used for an onward works contract supply. Classifying civil costs correctly during a project saves disputes at audit.
I am under QRMP in Chennai. When is my quarterly GSTR-3B due?
For taxpayers registered in Tamil Nadu, which falls in the category of states with the earlier date, the quarterly GSTR-3B under QRMP is due on the 22nd of the month following the quarter. So the return for April to June is due by 22 July, and so on for each quarter. The quarterly GSTR-1 is due by the 13th of the same month. The two are treated very differently. Goods disposed of as gifts or free samples attract the block under Section 17(5)(h), so ITC on inputs used for genuinely free samples must be reversed. However, CBIC Circular 92/11/2019 clarifies that buy-one-get-one offers are not free supplies; they are effectively two goods sold for a single price, tax is charged on that price, and full ITC remains available. Trade discounts recorded in the invoice also do not disturb credit. AdSense payments come from a Google entity located outside India and are remitted in convertible foreign exchange, so for an Indian creator this revenue generally qualifies as export of services, zero-rated when supplied under an LUT after registration. The income still counts towards your Rs.20 lakh aggregate turnover, so a creator whose combined receipts cross the threshold must register even if the entire revenue is export. Brand sponsorships from Indian companies, by contrast, are domestic supplies taxable at 18 percent.
