Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.
What it means for you: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.
Tvl. Vardhan Infrastructure v. Special Secretary — Madras High Court, 2024 · 2024-03-11
The Madras High Court examined the administrative division of taxpayers between Central and State GST authorities and held that, in the absence of a notification providing for cross-empowerment, the counterpart administration cannot initiate proceedings against a taxpayer assigned to the other authority. The statutory framework on cross-empowerment operates as a safeguard against parallel and overlapping action, and proceedings initiated by the wrong administration are without jurisdiction. The ruling is widely cited in jurisdictional challenges.
Why this matters: Check which administration your GSTIN is assigned to — a notice from the other wing can be challenged on jurisdiction, though verify the current appellate status before relying solely on this ground.

The Council approved the draft SGST law and the draft UTGST law, completing the legislative package begun at the previous meeting, and also approved amendments to the GST (Compensation to States) Bill including the ceiling rates at which compensation cess could be imposed. Placing the cess ceilings in the statute meant that later cess increases, such as the one on cigarettes a few months afterwards, could be made by notification without returning to Parliament.
