Owing to a mistake, the company's GSTR-3B for one month was filed showing nil figures even though the tax had actually been paid, and the portal offered no way to correct it. The department refused rectification. The High Court held that a taxpayer cannot be left without a remedy for a bona fide error where the tax was in fact paid and no revenue was lost, and directed the authorities to allow the correction so that the liability and the recipient's credit were properly reflected.
Practical effect: A genuine reporting error in GSTR-3B is worth pressing before the department rather than absorbing — courts have ordered correction where no tax was actually short paid.
Notification No. 32/2023-Central Tax · 2023-07-31
CBIC exempted registered persons whose aggregate turnover in FY 2022-23 was up to Rs 2 crore from filing the annual return GSTR-9 for that year, continuing the relaxation given for earlier years. The exemption is optional, meaning eligible taxpayers may still file voluntarily, which can be useful to correct reporting errors of the year. GSTR-9C remained applicable only above Rs 5 crore, so small taxpayers had no annual filing burden at all.
Why this matters: Small businesses under Rs 2 crore turnover need not file GSTR-9 for FY 2022-23, but voluntary filing is worth considering when monthly returns contain errors needing disclosure.
GSTN Advisory, September 2022 — changes in Table 4 of Form GSTR-3B pursuant to Notification No. 14/2022-Central Tax, dated 5 July 2022 and Circular No. 170/02/2022-GST, dated 6 July 2022 · 2022-09
From the August 2022 return period the whole of the credit appearing in GSTR-2B must first be reported as credit available in Table 4(A), with ineligible and reversible credit then shown separately in Table 4(B). Reversals that can be reclaimed later, such as those under Rule 37, go into Table 4(B)(2) and the reclaim is reported in Table 4(D)(1). Only the net figure reaches the electronic credit ledger.
Practical effect: Report gross credit and reversals separately in Table 4, because the department now compares your ledger with GSTR-2B line by line.
