The taxpayer had deposited about Rs. 29.83 crore into the electronic cash ledger before the due dates but filed GSTR-3B late for several tax periods between July 2017 and December 2019, and interest was demanded for the delay. The High Court dismissed the challenge, holding that a deposit in the electronic cash ledger is only money held to the taxpayer's credit and does not discharge tax liability. Liability is discharged only when the ledger is debited on filing the return, so interest runs until then.

What it means for you: Depositing cash into the ledger early does not protect you from interest — the GSTR-3B must actually be filed on time.

Entry 18 exempts transportation of goods by road and by inland waterways, but carves out two categories: a goods transport agency and a courier agency. The practical effect is that a truck owner who simply carries goods without issuing a consignment note supplies an exempt service, while a transporter who issues a consignment note becomes a goods transport agency and his service is taxable, usually in the hands of the recipient under reverse charge. The consignment note is therefore the dividing line between exemption and taxability.

The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

What to do about it: Tamil Nadu was one of only two States selected for this pilot, though the scheme was never rolled out in practice.

Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.

Generally no. Section 17(5)(a) blocks credit on motor vehicles for transporting persons with approved seating up to thirteen including the driver, even when used for business, unless you are in the business of further supplying such vehicles, transporting passengers, or imparting driver training. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. A Chitlapakkam trading company buying a delivery van claims full credit; the director's sedan gets none. Classify each vehicle before claiming.
Who has to file the GSTR-9 annual return?

How do I file Form PMT-09 to move money between heads in my cash ledger?
Log in and open Services, then Ledgers, then Electronic Cash Ledger, and select File GST PMT-09 for transfer of amount. The screen shows your balance under each major and minor head. Choose the transfer-from head and amount, choose the transfer-to head, add the details to the table, preview and file with DSC or EVC. The transfer reflects in the ledger immediately and an ARN is generated for your records. There is no limit on how often PMT-09 can be filed, and no government fee applies, so it is always the first fix for a wrong-head deposit.
