Meeting shortly after the Kerala floods, the Council discussed that State's proposal to impose a cess on SGST to fund rehabilitation and flood-related works. Because GST had removed the States' independent power to levy such a cess, the Council constituted a seven-member Group of Ministers convened by the Deputy Chief Minister of Bihar, with members from Assam, Kerala, Maharashtra, Odisha, Punjab and Uttarakhand, to examine modalities for revenue mobilisation in case of natural calamities and disasters, reporting by 31 October 2018.
What to do about it: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
Circular No. 176/08/2022-GST · 2022-07-06
The Board withdrew Circular No. 106/25/2019-GST dated 29 June 2019, which had prescribed a special refund mechanism for retail outlets in the departure area of international airports supplying indigenous goods to outgoing international passengers. The special procedure on which that mechanism rested was discontinued, so the separate refund route no longer operates. Such outlets must now follow the ordinary refund provisions instead of the withdrawn special procedure.
Why this matters: Duty free operators at Chennai airport should file under the normal export refund provisions, as the older special refund circular no longer exists.

A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.
What to do about it: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.
