It argued that these were only flours of cereals and pulses taxable at 5 percent. The Authority classified the products under heading 2106 90 as food preparations not elsewhere specified, attracting 18 percent GST, because the mixing and added ingredients took them out of the concessional flour entries. The Appellate Authority upheld that classification.

CBIC waived late fee in excess of Rs 500 per return (CGST plus SGST) for composition taxpayers who had not filed GSTR-4 for the quarters from July 2017 to March 2019 or for the financial years 2019-20 to 2021-22, and waived it fully where the return was a nil return. The concession applied to returns filed between 1 April 2023 and 30 June 2023, a window later extended to 31 August 2023.
Why this matters: Composition dealers with old unfiled GSTR-4s could clear the entire backlog for a nominal cost, so pending-return notices from this period should cite this amnesty.
