The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.

AAR Ruling

No second levy of IGST when goods leave a Free Trade Warehousing Zone

The Bank of Nova Scotia - AAR Tamil Nadu, Order No. TN/23/AAR/2018, dated 31 December 2018 · 2018-12-31

The bank imported goods and stored them in a Free Trade Warehousing Zone before they were cleared. It asked whether integrated tax was payable again when the goods were removed from the zone to the domestic tariff area, over and above the tax collected at the time of customs clearance. The Authority, following Circular No. 3/1/2018-IGST dated 25 May 2018, held that the applicant is not liable to pay IGST at the time of removal, the levy arising once at clearance for home consumption.

What to do about it: Chennai importers using FTWZ facilities pay IGST once at clearance and should resist any demand for a second levy on removal.

The original blanket exemption for renting a residential dwelling

Entry 12, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. From 1 July 2017 to 17 July 2022 a house or flat let out for residential use carried no GST, whether the tenant was an individual, a firm or a company. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.

Practical effect: For rent periods up to 17 July 2022 a Chennai landlord had no GST liability on residential letting, which is a useful defence if an old notice questions those years.

Is e-invoicing compulsory for my business, and at what turnover?

However, taxpayers with aggregate turnover above Rs.500 crore must print a dynamic QR code on B2C invoices to enable digital payment, which is a separate requirement from e-invoicing. Since 18 July 2022, specified food items such as rice, wheat, atta, pulses and flours attract 5% GST when sold in pre-packaged and labelled packs up to 25 kilograms, that is, packs bearing declarations required under the Legal Metrology Act. The same items sold loose, or in bulk packs above 25 kilograms, remain exempt. How is the place of supply decided when I sell goods?
Section 10 of the IGST Act gives the tests. Where the sale involves movement of goods, the place of supply is the location where the movement terminates for delivery to the recipient, whoever arranges the transport. Where there is no movement, it is the location of the goods at the time of delivery, which covers over-the-counter sales and sales of installed machinery in place. Where goods are assembled or installed at site, the place of supply is the site of installation.
