This notification inserted a new entry in the services reverse charge list so that, from 18 July 2022, where a residential dwelling is rented to a registered person, that registered person must pay the tax. The landlord does not charge GST and often is not even registered. The registered tenant issues a self-invoice, pays 18 per cent in cash and takes credit where the premises are used for business. Where goods against a single invoice are received in lots or instalments, the first proviso to Section 16(2) permits the credit only upon receipt of the last lot. So if machinery invoiced in March arrives in four consignments ending in May, the entire ITC is claimable only in May, even though the invoice is dated March. Claiming it earlier is a premature availment that can be flagged in scrutiny. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.

No. The 5% levy on specified food items applies only when they are supplied in pre-packaged and labelled form in packs up to 25 kilograms.
