After an October 2024 advisory and a January 2025 deferment, GSTN confirmed that from the July 2025 tax period the auto-populated outward tax liability in GSTR-3B, drawn from GSTR-1, IFF or GSTR-1A, is hard-locked and cannot be edited manually while filing. Any correction to sales figures must be made through GSTR-1A before GSTR-3B is filed. The change is intended to end mismatches between GSTR-1 and GSTR-3B.

CBIC v. Aberdare Technologies (P) Ltd — Supreme Court, 2025 (SLP against Bombay HC order dated 29-07-2024 dismissed) · 2025-03-21

The Bombay High Court permitted Aberdare Technologies to correct bona fide clerical errors in its GST returns beyond the statutory deadline where there was no loss of revenue. Dismissing the department's SLP, the Supreme Court observed that human errors are normal, denying correction unjustifiably burdens taxpayers and benefits the department at their cost, and asked CBIC to re-examine the rigid timelines for rectifying returns since software limitations cannot defeat substantive rights.

My credit notes this month exceed my sales. Can GSTR-3B show a negative figure?
Yes. Since the January 2024 tax period, the portal permits negative values in Table 3.1 of GSTR-3B where credit notes issued in a month exceed the outward supplies, a situation common in businesses with heavy sales returns. The resulting negative liability is carried forward automatically by the system and adjusted against the liability of subsequent tax periods, so you no longer need to defer reporting credit notes. Ensure the same credit notes are reported in GSTR-1, because GSTR-3B auto-populates from it and manual deviations invite the portal's variance flags. Retailers with seasonal return spikes benefit most from this facility.
How does a GTA opt for forward charge, and by when must it be done?
The option is exercised by filing the Annexure V declaration on the GST portal. For an existing GTA, the window for a financial year runs from 1 January to 31 March of the preceding financial year, so the choice for the coming year must be locked in by 31 March. A newly registered GTA must file the declaration within forty-five days of applying for registration or one month from the date of obtaining registration, whichever is later. Once exercised, the option continues for future years automatically unless the GTA files Annexure VI to revert to reverse charge. Missing the window means remaining under the default reverse charge mechanism for the whole year.
The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
When is GSTR-1 due for my business in Foreshore Estate?

Yes. Every registered taxpayer must file returns for every tax period, even when there are no sales, no purchases and no tax liability. In that case you file nil GSTR-1 and nil GSTR-3B. Failure to file nil returns attracts a late fee of Rs.20 per day per return, capped at Rs.500 per return, and breaks the sequential filing chain. I deposited money under the wrong head in my GST cash ledger. Why can the amount not be used?
The cash ledger is divided into major heads, IGST, CGST, SGST and cess, and minor heads, tax, interest, penalty, fee and others. An amount deposited under one combination, say CGST-penalty, cannot be directly used to pay under another, say IGST-tax, which is why your balance appears unusable despite money lying in the ledger. The remedy is Form PMT-09, which transfers the amount to the correct head instantly without any officer approval. Our company paid fees to a lawyer. Who pays the GST on this?
You do, as the recipient. Legal services supplied by an individual advocate, a firm of advocates or a senior advocate to a business entity are notified under Section 9(3), so the advocate does not charge GST and your business pays 18 percent under reverse charge in cash through GSTR-3B, claiming it back as ITC if otherwise eligible. Relief exists for small recipients: legal services to a business entity whose turnover is within the registration threshold are exempt. Since the advocate is usually unregistered, remember to raise a self-invoice and payment voucher for the transaction. Litigation-heavy businesses in Foreshore Estate should reconcile their legal expense ledger against RCM paid every quarter.
Can I reduce GST for discounts given after the sale, like turnover incentives?

Note that the older exemptions for small consignments, Rs.1,500 for a full truckload and Rs.750 for a single consignee, were withdrawn with effect from 18 July 2022, so ordinary cargo enjoys no value-based relief now. Transporters serving agricultural markets should describe the produce accurately on the consignment note to support the exemption.
