Cancer drugs cut to 5 per cent; namkeens and savoury snacks cut to 12 per cent

54th GST Council Meeting, New Delhi — 9 September 2024 · 2024-09-09

The Council reduced GST on three cancer drugs — Trastuzumab Deruxtecan, Osimertinib and Durvalumab — from 12 per cent to 5 per cent. Extruded or expanded savoury snacks and namkeens were cut from 18 per cent to 12 per cent prospectively, aligning them with similar ready-to-eat namkeens, while un-fried snack pellets stayed at 5 per cent. The Council also brought roof-mounted package unit (RMPU) air conditioning machines for railways under 28 per cent and moved car seats from 18 per cent to 28 per cent.

The taxpayer had reported credit under the wrong heads in GSTR-3B, showing IGST instead of CGST and SGST, although the total credit taken matched the tax actually borne on purchases. A demand was raised for wrongly availed credit. The Division Bench held that a clerical and revenue-neutral error in classifying credit between heads does not amount to wrong availment attracting demand and interest, and the demand raised only on that ground could not be sustained.

Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. I have been charging the wrong GST rate on my invoices. How do I fix it?
The correction depends on the direction of the error. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. DRC-01, by contrast, is the summary of a formal show cause notice under Section 73 or Section 74, which starts adjudication and must be answered in Form DRC-06. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again.
