Goods in transit were detained and the trader paid the penalty demanded under Section 129 in order to get the consignment released, while also filing written objections. The department treated the matter as closed. The Supreme Court held that payment made under commercial compulsion is not a voluntary admission, and that where objections are on record the officer must still pass a reasoned speaking order in Form GST MOV-09. Without such an order the statutory right of appeal becomes illusory.

The clock runs from communication of the order, which is usually the date it is served on the portal. Diarise the deadline the day you receive any adverse order, because gathering documents, computing the pre-deposit and drafting grounds takes time. What happens after I file Form APL-01 on the GST portal?
The portal issues a provisional acknowledgment immediately, and the appeal is formally admitted when the final acknowledgment in APL-02 is issued after document verification. The appellate authority then fixes personal hearings, where your authorised representative argues the grounds and files written submissions and case law. Up to three adjournments may be granted per side. The authority must pass a speaking order, which it should endeavour to issue within one year of filing, and the outcome is communicated in a summary along with the order. The authority can confirm, modify or annul the order but cannot send the case back to the original officer.
I discovered an old ASMT-13 order only after the return-filing window closed. What can I do now?
Once the sixty-day window and the further sixty-day extended window under Section 62 have both lapsed, filing the return no longer withdraws the order, and the estimated demand in the liability register becomes recoverable. Your remedy shifts to an appeal in Form APL-01 within three months of the order's communication, with the prescribed pre-deposit, arguing the actual figures from your books against the officer's estimate. Appellate authorities regularly scale down best judgment estimates when the genuine return data is placed on record. What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. An audit under Section 65 is far wider: officers examine your books of account, records and returns together, can visit your premises, and test classification, valuation, ITC eligibility and exemptions for the years covered by the ADT-01. Can I use my input tax credit balance to pay a DRC-03 liability?
Partly. The tax component of a DRC-03 payment can be settled from the electronic credit ledger, subject to the usual cross-utilisation rules between IGST, CGST and SGST. However, interest, penalty and late fee can never be paid from credit; those components must come from the electronic cash ledger, so you may need to deposit a challan first. The portal shows both ledger balances on the payment screen and lets you split the utilisation. Planning this split correctly avoids depositing cash unnecessarily when credit is lying idle, which is a routine saving we make for clients every month.
The department has provisionally attached my bank account under Section 83. What does that mean?
Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
How is GST charged on hotel room tariffs after the rate changes?
Hotel accommodation with a value of supply up to Rs.7,500 per unit per day attracts 5 percent GST without input tax credit, a reduction from the earlier 12 percent. Rooms priced above Rs.7,500 per day attract 18 percent with full input tax credit. The rate is determined by the actual transaction value charged for the room, so seasonal discounts can change the applicable rate on the same room across bookings. Which everyday goods now attract 5 percent GST?

Our security agency does not charge GST on its bills. Is that correct?
Quite possibly, yes. Since 1 January 2019, security services meaning supply of security personnel, when provided by any person other than a body corporate to a registered person, fall under reverse charge, so the agency correctly bills without tax and you pay 18 percent through GSTR-3B in cash, claiming ITC. If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. I am a composition dealer. Which returns apply to me and when?
