Practical effect: This process produced the Kerala flood cess of 2019, the only State-specific GST cess so far, and set the template for how any similar Tamil Nadu levy would have to be approved.
Circular No. 200/12/2023-GST, dated 1 August 2023 · 2023-08-01
Giving effect to the 50th GST Council decisions, CBIC clarified that un-fried and uncooked snack pellets manufactured by extrusion are classifiable under tariff item 1905 90 30 and attract five per cent with effect from 27 July 2023, and that fish soluble paste moved from eighteen to five per cent from the same date. Imitation zari thread or yarn made from metallised polyester or plastic film was placed at five per cent, and past periods were regularised on an as-is basis.
Why this matters: Snack and zari manufacturers in and around Chennai got both a lower rate and protection for past periods, so old demands on these items should be contested with this circular.
Premier Sales Promotion (P) Ltd v. Union of India — Karnataka High Court, 2023 · 2023-01-16
A company procuring and supplying prepaid vouchers, gift cards and e-vouchers to corporate clients was held liable to GST by the AAR and AAAR. The Karnataka High Court reversed, holding that vouchers are in the nature of pre-deposit instruments or actionable claims — a means of payment for future supplies — and their mere trading is neither a supply of goods nor of services, so no GST is payable on the voucher itself. CBIC later clarified voucher taxation consistently with this position.
Why this matters: Businesses running gift card and reward programmes should tax the underlying redemption supply, not the voucher transaction, and review past assessments in light of this ruling.
