Finalising the formats behind the principles approved in May, the Council approved optional quarterly return filing with monthly payment of tax for small taxpayers with turnover below Rs 5 crore, noting that 93 per cent of taxpayers fall below that figure. Two simplified formats were designed: Sahaj for small traders making only B2C supplies and Sugam for those making both B2B and B2C supplies. Both required less information than the regular return.
What to do about it: Sahaj and Sugam were never implemented as designed, but the Rs 5 crore turnover line and the quarterly-return-with-monthly-payment model survive in today's QRMP scheme.
GSTN Advisory, January 2024 — introduction of Tables 14 and 15 in GSTR-1 and the Invoice Furnishing Facility · 2024-01
From the January 2024 tax period, GSTR-1 and the Invoice Furnishing Facility carry two additional tables. Table 14 is filed by the seller and splits supplies made through an e-commerce operator between those on which the operator collects tax at source under Section 52 and those on which the operator itself pays tax under Section 9(5). Table 15 is filed by the e-commerce operator for supplies on which it discharges the tax under Section 9(5).
Why this matters: Sellers on marketplaces must map each order to the correct table, because mismatches here drive notices on tax collected at source credit.
Paschimanchal Vidyut Vitran Nigam Ltd v. Raman Ispat (P) Ltd — Supreme Court, judgment dated 17-07-2023 · 2023-07-17
The Supreme Court distinguished its earlier Rainbow Papers ruling and held that in liquidation, government and statutory dues fall under Section 53(1)(e) of the Insolvency and Bankruptcy Code, ranking below secured creditors and workmen's dues. Rainbow Papers was confined to its own facts, where a resolution plan had been approved ignoring statutory dues. The waterfall mechanism laid down by Parliament must be respected and cannot be overridden by a general statutory charge.
What it means for you: For a Chennai business in liquidation, GST arrears will be paid only after secured lenders and workmen, which affects how recovery notices against the company should be handled.
