The Council gave promoters a one-time option to continue paying tax at the old effective rates of eight or twelve per cent with input tax credit on ongoing projects, meaning buildings where both construction and actual booking had started before 1 April 2019 and which were not completed by 31 March 2019. The option had to be exercised once within a prescribed time frame, failing which the new rates applied automatically. Credit for projects moving across was to be transitioned pro rata.

CBIC again invoked Section 168A to extend the time for passing orders under Section 73(10) to 30 April 2024 for FY 2018-19 and 31 August 2024 for FY 2019-20. The notification has been challenged in several High Courts on the ground that it was issued without a prior GST Council recommendation and without any subsisting force majeure, and the validity question is presently before the Supreme Court, with many demand orders kept alive subject to the outcome.
What to do about it: Demands for 2018-19 and 2019-20 passed under this extended timeline should be defended on merits while also preserving the limitation objection, since the notification's validity is still open.

The Supreme Court held that where a special taxing statute provides a complete code with its own limitation scheme, the general provisions of the Limitation Act permitting condonation of delay do not apply.
