The Chairperson offered a compromise between a fixed 13 per cent growth rate, an average of three of the preceding five years' growth after removing the highest and lowest, and a 14 per cent rate pressed by Kerala and Assam. The Council unanimously agreed that projected State revenue for compensation purposes would grow at a flat 14 per cent per year from the 2015-16 base, with CST in that base counted at the actual 2 per cent. This single number determined the size of the compensation bill for the five-year guarantee period and, when actual GST collections fell short of it, drove the compensation cess extensions and the back-to-back borrowing arrangements of later years.

What to do about it: The 14 per cent guarantee is the reason compensation cess outlived its original five-year sunset, so cess-bearing goods remain costlier than the headline GST rate suggests.

The important exception is the offence of issuing invoices without any actual supply of goods or services, where the lower threshold continues, reflecting the government's focus on fake billing networks. The same amendments also decriminalised certain lesser offences, including obstruction of an officer and failure to supply information. Prosecution is in addition to, not instead of, the monetary penalties and demand proceedings.
What is compounding of offences under GST and how much does it cost?
Compounding under Section 138 lets an accused settle a criminal prosecution by paying a compounding amount, after which no further criminal proceedings are initiated and any pending prosecution abates. It is available either before or after the institution of prosecution, but only after the tax, interest and penalty involved have been paid. Following the Finance Act 2023, the compounding amount ranges between 25 percent and 100 percent of the tax involved, substantially lower than the earlier slabs. The application is made in Form CPD-01 to the Commissioner, who passes an order in CPD-02 within ninety days. Compounding buys certainty; it does not erase the civil demand.
I received Form ADT-01 saying my business is selected for GST audit. What does it mean?
ADT-01 is the intimation that the department will conduct an audit of your records under Section 65. The notice must be issued at least fifteen working days before the audit begins and will specify the financial years covered and the documents required. The audit may happen at your place of business or at the department's office. It is a detailed examination of returns, books, ITC claims and classifications, not a routine visit. Use the fifteen-day window to reconcile your data and organise records rather than waiting for the officers to arrive. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. What happened to the old 12 percent and 28 percent GST slabs?
Both slabs were abolished with effect from 22 September 2025. Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction. In contrast, sitting fees, commission and professional charges paid to independent or non-executive directors, typically suffering TDS under Section 194J, are taxable and the company pays 18 percent under reverse charge, claiming ITC.
