Notification No. 83/2020-Central Tax · 2020-11-10

From January 2021 the outward supply statement in Form GSTR-1 became due on the 11th day of the month following the tax period for monthly filers. For registered persons furnishing GSTR-1 quarterly under the new scheme, the statement became due on the 13th day of the month following the quarter. This replaced the earlier practice of notifying due dates a few months at a time and gave the return calendar a stable shape that has continued since.

We hire security guards from an agency. Should they charge GST or should we pay it ourselves?
Check the agency's constitution. Since 1 January 2019, security services by way of supply of security personnel provided by any person other than a body corporate to a registered person fall under reverse charge, so your business pays the 18 percent directly and claims credit. If the agency is a body corporate, such as a private limited company, it charges GST under forward charge on its invoice. Recipients registered under the composition scheme are excluded from this reverse charge entry. For the first two months of each quarter, tax is deposited through challan PMT-06 by the 25th of the following month. You can use the fixed sum method, paying 35 percent of the tax paid in cash in the previous quarter (or 100 percent of the tax paid in cash in the last month of the previous quarter if you were a monthly filer), or the self-assessment method, paying actual liability after adjusting input tax credit. Do I have to issue an invoice for every small cash sale in my shop?

What falls under the 18 percent standard rate of GST now?
The 18 percent slab is the standard rate for most services and for goods that are neither essentials nor demerit items. Can one document cover both taxable and exempt items sold together?
Yes, in one specific situation. Rule 46A permits a registered person supplying both taxable and exempt goods or services to an unregistered recipient to issue a single invoice-cum-bill of supply covering the entire transaction. This saves retail counters from splitting every mixed basket into two documents. The concession applies only when the buyer is unregistered; for a registered buyer, you must still issue a tax invoice for the taxable items and a separate bill of supply for the exempt items. Supermarkets and pharmacies with mixed inventories use this format daily, and billing software handles the split automatically once configured.
What is the GST rate on a works contract for a commercial building?
Under GST, a works contract relating to immovable property is treated wholly as a supply of services, and the standard rate is 18 percent on the contract value, with the contractor eligible for input tax credit on cement, steel and other inputs. This applies to construction, fabrication, erection, repair and renovation contracts for factories, offices and commercial buildings. The old VAT-plus-service-tax splitting of material and labour is gone; one rate applies to the whole consideration.
