The late fee under Section 47 for GSTR-3B was waived for the March and April 2021 tax periods, later extended to May 2021, for a specified number of days beyond the due date. Taxpayers with turnover above Rs 5 crore received a fifteen-day waiver while smaller taxpayers received thirty days, with a corresponding waiver for quarterly filers of the January to March 2021 quarter. Beyond the waived window the ordinary late fee applied from the original due date.
What to do about it: Returns for March to May 2021 filed within the extended window carry no late fee, and portal-generated demands for those months are frequently overstated.

Finalising the formats behind the principles approved in May, the Council approved optional quarterly return filing with monthly payment of tax for small taxpayers with turnover below Rs 5 crore, noting that 93 per cent of taxpayers fall below that figure. Two simplified formats were designed: Sahaj for small traders making only B2C supplies and Sugam for those making both B2B and B2C supplies. Both required less information than the regular return.
What it means for you: Sahaj and Sugam were never implemented as designed, but the Rs 5 crore turnover line and the quarterly-return-with-monthly-payment model survive in today's QRMP scheme.

The dealer inadvertently reported supplies under the wrong tax heads in its GSTR-1 and GSTR-3B, with the result that its customers could not claim the credit. The statutory window for amendment had closed. The Madras High Court permitted rectification of the returns for the relevant period, reasoning that the error was bona fide, the revenue suffered no loss, and the mechanism that would have allowed the taxpayer to detect the mismatch (the auto-populated matching forms) had never been made operational.
What it means for you: If a genuine head-of-tax or classification error in your GST returns has blocked your customer's credit, the Madras High Court route to rectification is available even after the ordinary time limit has passed.
