Meeting by video conference barely a fortnight after rollout, the Council found that the combination of a twenty-eight per cent rate and the compensation cess rates originally fixed had left cigarettes bearing less tax than under the earlier excise and VAT regime, handing manufacturers a windfall. The Council recommended an increase in the compensation cess rates on cigarettes so as to align the total GST incidence with the pre-GST level, and the revised cess rates were notified with effect from 18 July 2017.

What it means for you: It showed early on that the Council would move within days to correct a rate that produced an unintended windfall, in either direction.

The Maharashtra appellate authority held that penal interest and cheque bounce charges collected by a finance company from borrowers who delayed instalments are consideration for tolerating an act and are liable to GST at 18 per cent. CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.

What it means for you: If you collect late payment penalties from customers, check whether the charge sits inside the main contract before deciding to levy GST on it.

Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. My GST registration was rejected in REG-05 after a clarification notice. Can I apply again?
Yes. A rejection order in Form REG-05 does not bar you from applying afresh. You can file a new registration application after curing the defects the officer pointed out, such as an incomplete rental agreement, mismatched address proof or missing authorisation letter. Alternatively, if you believe the rejection was wrong, you can challenge the order by filing an appeal in Form APL-01 within three months. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How do I get a provisional attachment on my property or bank account lifted quickly?
Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Injambakkam businesses, since no appeal is provided against DRC-22. How much time does the GST department have to issue a demand under Section 73?

If your security agency is a private limited company, however, RCM does not apply and it must charge GST on its invoice under forward charge. What is the electronic liability register on the GST portal and why should I check it?
The electronic liability register, maintained in Form PMT-01, records every liability raised against your GSTIN: self-assessed tax from returns in Part I, and demands from assessments, adjudication orders and DRC-07 summaries in Part II.
