GSTN Advisory, January 2025 — filing of waiver applications under Section 128A · 2025-01
GSTN enabled Forms SPL-01 and SPL-02 on the portal from the first week of January 2025 for the Section 128A waiver scheme, under which taxpayers with Section 73 demands for FY 2017-18 to 2019-20 could get interest and penalty waived by paying the tax in full by 31 March 2025. Advisories explained eligibility, the need to withdraw pending appeals first, and the application deadline of 30 June 2025, with a further June 2025 advisory addressing technical glitches faced while submitting applications.
Practical effect: If you settled 2017-20 demands under the amnesty, preserve the SPL filings and payment proofs; if you missed it, factor full interest into dispute strategy.

Five assessment orders dated 16 June 2023 covering 2017-18 and 2019-20 to 2022-23 were challenged for want of a personal hearing under Section 75(4). The Madras High Court granted conditional relief: on the petitioner depositing a further 15 per cent of the disputed tax within thirty days over and above the 10 per cent already paid, the orders would stand quashed, replies were to be filed to the notices, and fresh orders were to be passed within six months. Failing compliance, the petitions would stand dismissed.
Why this matters: Natural-justice relief in Tamil Nadu now usually comes with a pre-deposit condition, so budget for roughly 25 per cent of the disputed tax when planning a writ petition.
Circular No. 248/05/2025-GST · 2025-03-27
Issued alongside the Rule 164 amendment, this circular settles the position that tax already paid through GSTR-3B before 1 November 2024 towards a disputed demand counts as payment for the Section 128A waiver, even though Rule 164 otherwise contemplates payment through Form DRC-03 or against the demand order. It gives field formations the procedural guidance for accepting such earlier return-based payments when processing SPL-01 and SPL-02 applications.
Practical effect: Do not abandon an amnesty application merely because the tax was paid earlier through returns rather than DRC-03; that payment counts towards the waiver.
