GSTN Advisory dated 24 September 2024 — archival of GST returns data older than seven years · 2024-09-24
GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.
What to do about it: Download and store PDF and JSON copies of every GSTR-1, GSTR-3B and GSTR-9 filed since 2017, because archived returns cannot be retrieved from the portal during an audit or appeal.

The manufacturer supplied electrical wiring harness, essentially electrical wire with connectors at both ends, used in motor vehicles, and asked whether it should be classified as a motor vehicle part or as insulated electrical conductors. The Authority classified the product under heading 8544, which covers insulated wire and cable fitted with connectors, taxable at 9 percent central tax and 9 percent State tax following Notification No. 41/2017-Central Tax (Rate) dated 14 November 2017, the earlier rate having been higher.
What to do about it: Chennai auto component makers should classify by the tariff description of the article itself, not by the vehicle it eventually goes into.
Pentacle Plant Machineries (P) Ltd v. Office of the GST Council — Madras High Court, W.P. No. 1022 of 2020, decided 23 February 2021 (Anita Sumanth J.) · 2021-02-23
The supplier keyed in the customer's Uttar Pradesh GST number instead of the Andhra Pradesh one while filing GSTR-1, and the correction window had lapsed. The Madras High Court allowed the writ petition and directed that the return be permitted to be amended, describing the mistake as a bona fide human error. The Court observed that assessees should not be prejudiced from availing credit they are otherwise legitimately entitled to, particularly where the matching forms were never notified.
What it means for you: A typographical GSTIN error that has cost your buyer their credit is curable — do not simply write off the credit as lost because the portal has closed the amendment window.
