The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.

This circular made four significant changes. Refund claims cannot be bunched across financial years. Refund of accumulated credit on account of an inverted duty structure is not available where the inversion arises only because the rate on the same goods was reduced over time, since input and output are the same. Refund of tax paid on supplies other than zero-rated is repaid proportionately in cash and credit. Most importantly, refund of accumulated credit is restricted to invoices actually reflected in the applicant's GSTR-2A, and HSN or SAC must be shown in Annexure-B.
What to do about it: Refund working papers must now tie back to GSTR-2A invoice by invoice, and traders whose stock simply became cheaper cannot claim an inverted-duty refund.
Entry 74, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28
Entry 74 exempts health care services provided by a clinical establishment, an authorised medical practitioner or paramedics, and the transportation of a patient in an ambulance. Health care services are defined as diagnosis, treatment or care for illness, injury, deformity, abnormality or pregnancy in any recognised system of medicine, and expressly exclude cosmetic or plastic surgery unless done to restore or reconstruct anatomy affected by injury or congenital defect. Hair transplant and purely cosmetic procedures are therefore taxable.
What to do about it: A Chennai hospital or clinic is exempt on treatment, but must charge GST on cosmetic procedures, pharmacy sales to outsiders and rental of space to shops.
