Use in agriculture does not by itself bring a product within the exempt agricultural implements entry, and the material and the tariff description prevail over the end use.

Circular No. 157/13/2021-GST dated 20 July 2021 · 2021-07-20

CBIC explained the effect of the Supreme Court's order of 27 April 2021 extending limitation. The extension applies where an appeal has to be filed against a quasi-judicial order before the Joint or Additional Commissioner (Appeals), the Commissioner (Appeals), the Appellate Authority for Advance Ruling, the Tribunal or the courts, or where a revision or rectification of an order has to be sought. It does not apply to proceedings a taxpayer has to initiate or compliances he has to make, which remain governed only by the statute and by the notifications issued under section 168A of the CGST Act, nor to the quasi-judicial work of officers such as deciding refund claims, revocation applications and demand adjudications, which may continue.

The Council approved a scheme to incentivise digital payment under GST. Concessions were to be given on B2C transactions paid through RuPay debit card, UPI, BHIM, USSD or BHIM-Aadhaar, by way of an automated refund to the consumer's account of twenty per cent of the total GST paid, subject to a ceiling of Rs 100 per transaction shared equally between CGST and SGST. The purchaser would be informed by SMS. The scheme was to run on a pilot basis in Assam, Tamil Nadu and any other volunteering State.

The portal auto-filled an interest amount in my GSTR-3B. Can I edit or dispute it?
The portal computes interest on delayed filings under Rule 88B and auto-populates it in Table 5.1 of the next period's GSTR-3B, with a break-up shown period-wise. The system value is based on your cash ledger debits and the days of delay, and while the field permits upward revision, reducing the system-computed figure will flag the return. If you believe the computation is wrong, for instance because a liability related to an earlier period was declared with correct interest already paid through DRC-03, pay what is correct and keep the working; the department can be satisfied later with the reconciliation. We verify these auto-computations for clients before every filing.
What is a debit note under GST and when do I issue one?
You issue a debit note when the taxable value or tax charged in the original invoice was less than what is actually payable, for example a price escalation clause kicking in or a rate charged short. Declaring the debit note in GSTR-1 increases your output liability, payable with interest where the shortfall relates to an earlier period. There is no outer time limit on issuing a debit note itself. For your buyer, the debit note is a credit document: following the amendment to Section 16(4), the buyer's time limit to claim ITC runs from the date of the debit note, not the original invoice.
Why is the portal not letting me file GSTR-1?
Under Rule 59(6) of the CGST Rules, the portal blocks GSTR-1 filing if the GSTR-3B of the preceding tax period has not been filed. GST returns are sequential, so a single skipped GSTR-3B stops the entire chain. The fix is to file the pending GSTR-3B along with its late fee and interest, after which GSTR-1 opens up again. What is the difference between CPIN and CIN, and how long is a GST challan valid?
When you generate a challan in Form PMT-06 on the portal, the system issues a fourteen-digit Common Portal Identification Number, the CPIN, which identifies the unpaid challan and remains valid for fifteen days. Once the bank receives your payment, a seventeen-digit Challan Identification Number, the CIN, is generated, comprising the CPIN plus the bank code, and the amount credits your electronic cash ledger. Which input tax credits are blocked under Section 17(5) even if they appear in GSTR-2B?
Section 17(5) blocks credit on specified items regardless of business use: motor vehicles for passenger transport with seating up to thirteen persons, unless used for resale, passenger transport or driver training; food and beverages and outdoor catering; club and fitness memberships; life and health insurance except where statutorily obligatory; works contract and construction services for immovable property other than plant and machinery; goods lost, stolen, destroyed, written off or given as gifts and free samples; and tax paid under composition. Reversing these while filing GSTR-3B avoids painful demands later. A blocked-credit review is part of every reconciliation ChennaiGST performs.

The two are treated very differently. Goods disposed of as gifts or free samples attract the block under Section 17(5)(h), so ITC on inputs used for genuinely free samples must be reversed. However, CBIC Circular 92/11/2019 clarifies that buy-one-get-one offers are not free supplies; they are effectively two goods sold for a single price, tax is charged on that price, and full ITC remains available. Trade discounts recorded in the invoice also do not disturb credit. Such under-construction sales attract 1 percent for affordable residential apartments and 5 percent for other residential apartments, both without input tax credit to the builder. Once the completion certificate is issued, sale of the building is neither a supply of goods nor of services under Schedule III, so a ready-to-move flat carries no GST at all, only stamp duty and registration charges. Timing of booking therefore changes the buyer's cost materially.
What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
