1st GST Council Meeting, New Delhi — 22-23 September 2016 (Signed Minutes, Agenda Item 3) · 2016-09-23
At its very first meeting the Council debated exemption thresholds ranging from Rs 10 lakh to Rs 25 lakh and finally agreed that a business would not need GST registration until its aggregate turnover crossed Rs 20 lakh. For the eleven Special Category States listed in Article 279A of the Constitution, the threshold was set at Rs 10 lakh. The Chairperson recorded that the figure would be reviewed after five years, once the compensation guarantee to States had run its course.
Practical effect: The Rs 20 lakh figure that still governs whether a small Chennai service business must register was settled at this meeting and has been the starting point for every later threshold change.
Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, Schedule I, Chapters 33 and 34 · 2025-09-17
Hair oil and shampoo, toilet soap in the form of bars and cakes other than industrial soap, toothpaste, tooth powder and dental floss were moved into Schedule I at five per cent from 22 September 2025, down from eighteen per cent. Other soaps and organic surface-active preparations, and dentifrices other than the listed items, remain in Schedule II at eighteen per cent, so the concession is confined to the everyday personal care items the Council named.
What it means for you: FMCG distributors must apply five per cent only to the named items and keep the balance of the toiletries range at eighteen per cent, since the split within one chapter is easy to get wrong.
Penuel Nexus (P) Ltd v. Additional Commissioner, Headquarters (Appeals) — Kerala High Court, judgment dated 13 June 2023 · 2023-06-13
An appeal under Section 107 was filed after the three-month period and beyond the further one month that the appellate authority may condone. The Kerala High Court held that the CGST Act is a special statute providing its own complete limitation scheme, and the appellate authority has no power to condone delay beyond the additional one month. A writ petition could not be used to bypass that statutory bar. The rejection was upheld.
Why this matters: Treat the four-month outer limit for a GST appeal as real — the safer course is always to file within three months of receiving the order.
