The Appellate Authority upheld that view.

Circular

No section 73(11) penalty for merely paying self-assessed tax late

Circular No. 76/50/2018-GST dated 31 December 2018 · 2018-12-31

This circular answered a set of unrelated questions. The most important is that the penalty under section 73(11) does not apply where self-assessed tax shown in the return is paid late; only interest under section 50 and, where warranted, general penalty under section 125 arise. It also dealt with the rate applicable to notes issued under section 142(2) and who is the owner of goods in transit. A corrigendum of 7 March 2019 clarified that tax collected at source under the Income-tax Act is not included in the taxable value.

Practical effect: If a demand adds a heavy penalty simply because GSTR-3B tax was paid late, this circular is the answer.

Entry 66, Notification No. 12/2017-Central Tax (Rate) dated 28.06.2017 · 2017-06-28

Entry 66 exempts services supplied by an educational institution to its students, faculty and staff, and services relating to admission to or conduct of examinations. It also exempts transportation of students, catering including any government-sponsored mid-day meal scheme, security, cleaning and housekeeping supplied to an institution, but only where that institution provides education up to higher secondary level. An educational institution is one whose output leads to a qualification recognised by law, so private coaching classes fall outside the exemption.

How are B2B and B2C invoices reported differently in GST returns?

Swiggy and Zomato pay the GST on my restaurant orders. How do I show these sales in my returns?
Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. The practical remedy is vendor follow-up: withhold the tax portion of payment until the supplier uploads, and claim the credit in the month it appears in GSTR-2B, subject to the overall time limit of 30 November following the financial year. Our company spends on CSR activities. Is the GST paid on those purchases creditable?
Not any more. Section 17(5)(fa), inserted with effect from 1 October 2023, specifically blocks input tax credit on goods or services used for corporate social responsibility activities under Section 135 of the Companies Act. Before this date the position was contested, with advance rulings going both ways, so credits availed for earlier periods may still be defensible on merits if questioned. For current periods, GST on CSR purchases, whether school furniture donated or medical supplies distributed, is a cost.
