The window was later extended further by subsequent notifications.

The Chennai trust, which provides education to mentally disabled children, applied for an advance ruling on the tax treatment of supplies it proposed to receive. The Authority did not admit the application under section 98(2) of the CGST and TNGST Acts, holding that an advance ruling can be sought only by a person who is undertaking or proposing to undertake the supply in question. A recipient cannot use the advance ruling route to settle the classification or the rate charged to it by its vendor.

The department had communicated the show cause notice only to the taxpayer's email address and never furnished it physically, with the result that the taxpayer remained unaware of the proceedings and no personal hearing took place. The Court held that this fell short of Section 75(4) and of natural justice, set aside the order, and remanded the matter on condition that the petitioner pay 25 per cent of the disputed tax and file objections, after which a proper notice and hearing must be given.
Practical effect: Chennai businesses that changed their email or accountant should still check the GST portal regularly, but an order passed on email-only service with no hearing can be reopened before the High Court.
