A five-judge Bench overruled the earlier view and held that a composite contract for manufacture, supply and installation of a lift is a works contract, because the lift comes into existence as a functional unit only on installation at site. The dominant nature test was rejected for contracts falling within the deemed sale of works contracts. The composite character of such contracts is now the basis of works contract taxation under GST.

It clarified that service by cloud kitchens and central kitchens is restaurant service attracting 5 per cent without input tax credit, while ice cream parlours that sell already manufactured ice cream without any element of cooking supply goods and attract the applicable goods rate with credit. It also clarified the treatment of coaching services supplied under a government scholarship scheme, overloading charges recovered at toll plazas, and services in relation to admission to amusement parks.

Departmental instructions require that arrest is not routine and must be justified by factors like flight risk or evidence tampering. Such estimates are usually far higher than the actual dues. The assessment is deemed withdrawn if you file the valid return within sixty days of the order, on payment of late fee and interest. Is GST payable on hostel or paying guest accommodation in Korukkupet?
