The High Court had awarded exporters interest at nine per cent on refunds released after delays of a few months. Reversing that, the Supreme Court held that the main part of Section 56 of the CGST Act fixes interest at six per cent, and the higher nine per cent rate applies only under the proviso, that is where the refund arises from an order of an adjudicating authority, appellate authority, tribunal or court. Courts cannot apply equitable rates where the statute has spoken.
What to do about it: A Chennai exporter chasing a delayed refund should claim interest at six per cent under Section 56 and reserve the nine per cent claim for refunds sanctioned pursuant to an appellate or court order.

There must be a minimum of three parties, and two distinct supplies, the main supply between two principals and the ancillary supply of arranging or facilitating it. The supplier must have the character of a broker or agent playing a supportive role, and a person supplying goods or services on his own account on a principal-to-principal basis is not an intermediary. Sub-contracting is expressly excluded, and illustrations are given for software support and marketing services.
What to do about it: Chennai IT, engineering and marketing firms serving overseas clients on a principal-to-principal basis should use this circular to defend export status and refund claims.

The Council agreed that taxpayers would be divided between Central and State tax administrations for all administrative purposes: of taxpayers with turnover below Rs 1.5 crore, 90 per cent would go to the State administration and 10 per cent to the Centre, while taxpayers above Rs 1.5 crore would be split equally. Division was to be by computerised stratified random sampling at the State level, with both administrations retaining intelligence-based enforcement powers over the whole value chain. West Bengal recorded its dissent.
