GSTN Advisory dated 24 September 2024 — archival of GST returns data older than seven years · 2024-09-24

GSTN advised that return data on the common portal is retained for seven years only, after which it is archived and no longer available for viewing or download. Archival started with the earliest tax periods of 2017-18 and proceeds month by month, so one further month of data drops off the portal every month. Taxpayers were advised to download and preserve their returns and supporting data before the archival date for each period.

My company has taken a residential flat on rent. Why is our accountant paying GST on it?
Because of a reverse charge entry effective 18 July 2022: renting of a residential dwelling to a registered person attracts 18 percent GST payable by the tenant under reverse charge, even when the landlord is unregistered. Renting to unregistered individuals for residence remains fully exempt. There is a carve-out from 1 January 2023: a proprietor renting a dwelling in his personal capacity for use as his own residence, on his own account and not for the business, is exempt. Companies and firms renting flats, including for guest houses, must therefore pay RCM monthly through GSTR-3B. We correct many such missed entries during our compliance health checks.
My bank account was debited for a GST challan but the cash ledger shows nothing. What do I do?
This is a payment-communication failure between the bank and the portal, and the prescribed remedy is Form PMT-07, filed under Services, then Payments, then Grievance against Payment. Quote the CPIN, bank name and debit details; the system takes up the discrepancy with the bank, and the amount either credits your ledger once the bank confirms, or is re-credited to your account if the transaction failed. Do not pay twice immediately; most cases resolve within a day or two. If a return due date is pressing, generate a fresh challan and later seek refund of the duplicate. Is there a late fee for filing GSTR-1 after the 11th?

Since 1 January 2022, tax on restaurant services supplied through e-commerce operators is payable by the operator under Section 9(5), so you do not charge GST on app orders and no TCS is collected on them either. You must still report these supplies: show them in GSTR-3B Table 3.1.1(ii) as supplies on which the operator pays tax, and disclose them in GSTR-1, without paying tax on them again. What is the difference between CPIN and CIN, and how long is a GST challan valid?

GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. What is IFF in the QRMP scheme?
The Invoice Furnishing Facility (IFF) is an optional facility for QRMP taxpayers to upload B2B invoices for the first two months of a quarter, by the 13th of the following month, up to Rs.50 lakh of invoice value per month. Invoices uploaded through IFF appear in your buyers' GSTR-2B immediately, so they can claim input tax credit without waiting for your quarterly GSTR-1. Section 17(5)(ab) extends the block to insurance, servicing and repairs of such vehicles. However, ITC is fully available on goods transport vehicles like trucks and delivery vans, and on vehicles with seating above thirteen such as staff buses. Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?

Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues.
