Notification No. 44/2019-Central Tax dated 09.10.2019 · 2019-10-09
This notification prescribed that the return in FORM GSTR-3B for each of the months from October 2019 to March 2020 was to be furnished electronically on or before the twentieth day of the month succeeding the month concerned, and that the tax due had to be discharged by debiting the electronic cash or credit ledger not later than the same date. It continued the practice of notifying GSTR-3B due dates in six month blocks.
How we apply it: The twentieth of the following month remains the familiar GSTR-3B deadline for larger Chennai taxpayers, and payment must accompany the return, not follow it.

The electronic credit ledger was blocked by a State Tax Officer. The High Court quashed the blocking, holding that Rule 86A permits only the Commissioner, or an officer authorised by him who is not below the rank of Assistant Commissioner, to exercise the power. A general delegation notification issued under the State GST Act could not override that express requirement written into the rule, so the order of the lower-ranked officer was without jurisdiction.
Practical effect: When your ledger is blocked, check the designation of the officer who signed the order — anything below Assistant Commissioner is open to challenge.
Dr. Dathu Rao Memorial Charitable Trust - AAR Tamil Nadu, advance ruling of 2018 rejecting the application under section 98(2) · 2018
The Chennai trust, which provides education to mentally disabled children, applied for an advance ruling on the tax treatment of supplies it proposed to receive. The Authority did not admit the application under section 98(2) of the CGST and TNGST Acts, holding that an advance ruling can be sought only by a person who is undertaking or proposing to undertake the supply in question. A recipient cannot use the advance ruling route to settle the classification or the rate charged to it by its vendor.
Practical effect: A Chennai business unhappy with the rate its vendor charges cannot file its own advance ruling application; the supplier has to apply.
