Food delivery platforms to pay the GST on restaurant service from January 2022

Circular No. 167/23/2021-GST dated 17 December 2021 · 2021-12-17

Following the 45th GST Council meeting, restaurant service supplied through an e-commerce operator was notified under section 9(5) with effect from 1 January 2022. CBIC clarified that the operator, and not the restaurant, is liable to pay the tax on such supplies, must discharge it in cash without using input tax credit, and issues the invoice for the service. The restaurant continues to pay tax on its own dine-in and direct sales, and the aggregate turnover of the restaurant still includes the supplies made through the platform.

Practical effect: Chennai restaurants listed on delivery platforms must separate platform sales from direct sales in their records, because the tax on the former is paid by the platform.

Coronation Arts Crafts - AAR Tamil Nadu, Advance Ruling No. 19/ARA/2022, dated 31 May 2022 · 2022-05-31

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

When reporting it in GSTR-1, the portal accepts credit notes without invoice-wise linking for this reason. Maintain a working annexed to the credit note listing the invoices covered, because in scrutiny the officer will ask you to establish the linkage and the arithmetic.
Is there a deadline for declaring credit notes for a financial year?
Yes, and it is strict. A credit note relating to an invoice of a financial year must be declared in your returns by 30 November following the end of that financial year, or the date of filing the annual return, whichever is earlier. After this date, you can no longer reduce your output tax through a GST credit note for that year's invoices; any adjustment becomes purely commercial with no tax benefit. What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. However, where a registered proprietor rents the dwelling in a personal capacity for use as his own residence, and on his own account rather than for the business, the exemption applies and no tax arises. If a company takes a flat as a guest house or for employee accommodation, RCM applies, and note that ITC on such rent may face challenge as a personal consumption expense. Document the purpose of the tenancy in the rent agreement so the correct treatment is defensible.
Can I transfer cash ledger balance from one GSTIN to another GSTIN of the same PAN?
Yes, within limits. Under Section 49(10), unutilised IGST and CGST balances in the electronic cash ledger can be transferred through PMT-09 to the cash ledger of a distinct person, that is, another GSTIN registered on the same PAN in the same or another state. SGST balances cannot be moved across states in this manner. The transfer is not permitted if the transferring GSTIN has any unpaid liability standing in its electronic liability register.
