The GST Appellate Tribunal's e-filing portal at efiling.gstat.gov.in became operational on 24 September 2025, finally giving taxpayers a forum for second appeals against orders of appellate and revisional authorities. Filing of appeals is mandatorily electronic, and advisories prescribe a phased, staggered schedule so that the backlog does not congest the system, with backlog appeals against pre-existing orders permitted to be filed up to 30 June 2026.

Acting on a Group of Ministers report, the Council cut rates on COVID relief goods until 30 September 2021. Tocilizumab and Amphotericin B moved to nil, while Remdesivir and anti-coagulants such as heparin were reduced to 5 per cent. Medical grade oxygen, oxygen concentrators, ventilators, BiPAP machines, COVID testing kits and specified diagnostic kits all moved from 12 to 5 per cent. Pulse oximeters, hand sanitiser, temperature check equipment and crematorium furnaces moved to 5 per cent, and ambulances from 28 to 12 per cent.

What to do about it: These were temporary rates with a hard expiry, so suppliers must be able to show that concessional invoices fall inside the notified relief period.

My GST registration was cancelled. Should I file an appeal or a revocation application?
If the cancellation was initiated by the department, for example for non-filing, the primary remedy is a revocation application in Form REG-21 within ninety days of the cancellation order, after filing all pending returns and clearing tax, interest and late fees. Revocation is quicker and handled by the same jurisdictional officer. An appeal in APL-01 within three months is the route when revocation is rejected, when the ninety-day window is lost, or when you dispute the very grounds of cancellation. Apart from the pre-deposit, is there any court fee for filing a GST first appeal?

How much pre-deposit do I have to pay for a GST appeal?
To file an appeal you must pay the admitted tax, interest and penalty in full, plus a pre-deposit of 10 percent of the disputed tax amount. Only the tax in dispute counts for the 10 percent; disputed interest and penalty do not require any pre-deposit, except that an appeal against an e-way bill detention penalty order under Section 129(3) requires payment of 25 percent of the penalty. Once the appeal is filed with this payment, recovery proceedings for the balance amount are deemed stayed until the appeal is decided. The pre-deposit can be paid from the electronic cash ledger, and courts have also accepted credit ledger payment for the tax component. My three-month appeal deadline has passed. Can I still file a GST appeal?
You have a narrow lifeline. How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
Who must sign GST filings with a DSC, and who can use EVC?
Companies and limited liability partnerships must authenticate registration applications and returns with a Digital Signature Certificate of the authorised signatory; the Electronic Verification Code route is not ordinarily available to them, though the government has periodically allowed EVC for companies during specified relaxation windows. Proprietorships, partnerships, HUFs and trusts can freely use EVC, an OTP sent to the authorised signatory's registered mobile and email. The DSC must be a Class 3 signature registered on the portal against the signatory's PAN. If a company's filings fail at the signing step, an expired or unregistered DSC is the usual culprit.
What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
Is GST payable on hostel or paying guest accommodation in Koyambedu?
A specific exemption effective 15 July 2024 covers accommodation services supplied at a value up to Rs.20,000 per person per month, provided the accommodation is supplied for a minimum continuous period of ninety days. Student hostels and working men's or women's PGs in Koyambedu charging within this limit for long stays are therefore exempt. Where the monthly charge exceeds Rs.20,000, or the stay is shorter than ninety days, the supply is taxable like ordinary accommodation. Operators should maintain stay records and agreements evidencing the duration, because the ninety-day condition is what officers test first during verification.
What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation. So a registered Koyambedu manufacturer paying a transporter for a Chennai-to-Delhi movement has Tamil Nadu as the place of supply, and the RCM liability is paid as CGST plus SGST if the transporter is also in Tamil Nadu. This rule matters chiefly for paying reverse charge on GTA freight under the correct heads, because paying IGST where CGST and SGST were due creates a refund-and-repay exercise later.
What is the penalty for running a business without GST registration?
A taxable person who is liable to register but fails to do so faces a penalty of Rs.10,000 or the amount of tax evaded, whichever is higher, under Section 122 of the CGST Act. Beyond the penalty, the department can demand the tax for the entire unregistered period with interest at 18 percent per annum, and you cannot recover that tax from customers you billed without GST. Goods moved without registration and e-way bills, required for consignments above Rs.50,000, also risk detention. If your turnover has crossed the threshold, registering within thirty days is far cheaper than regularising later.
What is self-invoicing under RCM and is there a time limit for it?
When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
Can my GST registration be cancelled for not filing returns?
Yes. Under Rule 21A, the department can suspend a GSTIN where returns are not filed for a continuous period, and Section 29 permits cancellation where a regular taxpayer has not filed returns for six months (two quarters for QRMP, and a composition taxpayer defaulting on the annual return beyond three months). During suspension you cannot issue tax invoices or file returns, which freezes the business. If cancellation happens, revocation must be sought through REG-21 within 90 days after clearing all dues.
