Charbhuja Granite v. Assistant Commissioner (ST) — Madras High Court, W.P. No. 25807 of 2025, decided 17 July 2025 (Krishnan Ramasamy J.) · 2025-07-17
The department had communicated the show cause notice only to the taxpayer's email address and never furnished it physically, with the result that the taxpayer remained unaware of the proceedings and no personal hearing took place. The Court held that this fell short of Section 75(4) and of natural justice, set aside the order, and remanded the matter on condition that the petitioner pay 25 per cent of the disputed tax and file objections, after which a proper notice and hearing must be given.
Why this matters: Chennai businesses that changed their email or accountant should still check the GST portal regularly, but an order passed on email-only service with no hearing can be reopened before the High Court.
Maharashtra State Power Generation Co Ltd — AAR Maharashtra, Order No. GST-ARA-15/2017/B-30, dated 8 May 2018 (upheld by AAAR) · 2018-05-08
The Maharashtra AAR held that liquidated damages recovered by MAHAGENCO from contractors for delayed completion of works are consideration for tolerating an act under Schedule II entry 5(e) of the CGST Act, classifiable under heading 9997 and taxable at 18 per cent. The AAAR upheld this view. The ruling drove years of demands on contract penalties, until CBIC Circular No. 178/10/2022-GST dated 3 August 2022 substantially narrowed the taxability of such recoveries by clarifying that genuine compensation for breach is not payment for tolerating an act.
What it means for you: Review old contracts where GST was paid or demanded on penalties and delay damages, as later clarifications may support refunds or defence against demands.
Notification No. 15/2021-Central Tax (Rate) dated 18.11.2021 · 2021-11-18
This notification removed the words governmental authority and government entity from the concessional works contract entries in the services rate notification. With effect from 1 January 2022, works contract services supplied to a governmental authority or a government entity ceased to enjoy the 12 per cent rate and moved to 18 per cent with input tax credit. Only supplies made directly to the Central Government, a State Government, a Union territory or a local authority continued at the concessional rate at that stage.
Why this matters: Chennai contractors working for boards, corporations and government companies moved to 18 per cent from 1 January 2022, and should have raised price-variation claims for contracts signed earlier.
