As originally notified, Entry 12 exempted renting of a residential dwelling for use as residence, without any condition about who the tenant was. The entry was narrowed with effect from 18 July 2022 so that the exemption no longer applies where the tenant is a registered person.

In a bungalow purchase where land constituted the dominant value, the Gujarat High Court held that the deeming fiction treating land value as one-third of the total consideration for GST on construction is arbitrary if applied mandatorily.
