Telangana AAAR reverses tax on solar project liquidated damages

Achampet Solar Pvt Ltd — AAAR Telangana, Order No. AAAR.COM/04/2022, dated 19 October 2022 (setting aside AAR Order No. 07/2022, dated 16 February 2022) · 2022-10-19

The Telangana AAR had held that liquidated damages recoverable by Achampet Solar from its contractor for delay in commissioning its solar plant were a taxable supply attracting 18 per cent GST. The Appellate Authority set that ruling aside on 19 October 2022, holding that such damages are compensation for breach of contract and not consideration for tolerating an act, so they do not qualify as a supply. The decision aligns with CBIC Circular No. 178/10/2022-GST dated 3 August 2022 on contractual damages.

Practical effect: Do not automatically charge GST on liquidated damages or penalty recoveries; test each clause against the 2022 circular before paying tax.

Bricks and roofing tiles kept at 12 per cent when GST 2.0 abolished that slab

Notification No. 14/2025-Central Tax (Rate), dated 17 September 2025 · 2025-09-17

Although the twelve per cent slab was otherwise removed, this standalone notification preserves it for the brick trade. From 22 September 2025 fly ash bricks, fly ash aggregates and fly ash blocks of heading 6815, bricks of fossil meals or similar siliceous earths of tariff item 6901 00 10, building bricks of tariff item 6904 10 00 and earthen or roofing tiles of tariff item 6905 10 00 attract six per cent central tax, that is twelve per cent combined.

Practical effect: A building material dealer in Chennai still bills bricks and roofing tiles at twelve per cent, not eighteen, and must not assume the GST 2.0 slab merger applied to them.

A repeat conviction can attract up to five years regardless of amount. Offences involving supply without invoice, invoices without supply, credit from such invoices, and collected-but-not-deposited tax are cognizable and non-bailable when the amount exceeds Rs.5 crore; everything else is non-cognizable and bailable. Courts take cognizance only with the Commissioner's previous sanction.
Is everyone facing GST prosecution eligible to apply for compounding?
No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. Either pay the demand, or file an appeal in Form APL-01 within three months of the order with a pre-deposit of 10 percent of the disputed tax, which stays recovery of the balance. If you do nothing, recovery action, including bank account attachment, can begin three months after the order, and even earlier in exceptional cases. What is the difference between GST return scrutiny and a departmental audit?
Scrutiny under Section 61 is a desk review of your filed returns, where the officer points out specific discrepancies through ASMT-10 and you explain them in ASMT-11; it is limited to what the returns reveal. Should I just pay the amount mentioned in a DRC-01A intimation?
Only after checking the working. DRC-01A is an invitation to settle before a show cause notice, and if you agree with the ascertainment you can pay through DRC-03 and intimate it in Part B, after which no notice is issued for that amount. In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. But officers' ascertainments often ignore reconciliations, eligible credits or amounts already paid. Is GST applicable on rent for my shop or office premises?
Yes. Renting of commercial property such as shops, offices, godowns and industrial sheds is a taxable supply of services at 18 percent, charged by the landlord under forward charge once the landlord's aggregate turnover, including this rent, crosses Rs.20 lakh. The tenant, if registered and using the premises for business, can claim the GST as input tax credit, since renting is not a blocked credit. Landlords with several small commercial properties often cross the threshold without realising it, because rent from all properties on the same PAN is clubbed. How do I register my DSC on the GST portal, and why does the emSigner error keep appearing?
After logging in, open My Profile and select Register or Update DSC, choose the authorised signatory's PAN, and sign with the USB token; the certificate must be Class 3 and the PAN on it must match the signatory's PAN on the portal. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. My customer in Mumbai asked me to deliver goods directly to his buyer in Madipakkam. How do I bill this?
This is a bill-to ship-to transaction under Section 10(1)(b). When goods are delivered to a third party on the instruction of your customer, the law deems your customer's principal place of business as the place of supply, not the actual delivery point.
