Reverse charge on hiring vehicles from a non-corporate supplier

Circular No. 130/2019-GST dated 31 December 2019 · 2019-12-31

CBIC clarified the reverse charge entry for renting motor vehicles designed to carry passengers where the cost of fuel is included in the consideration. Where the supplier is a person other than a body corporate who charges tax at five per cent without claiming input tax credit, and the recipient is a body corporate located in the taxable territory, the recipient pays the tax under reverse charge. Where the supplier is itself a body corporate, or charges the twelve per cent rate with credit, the reverse charge does not apply.

The Supreme Court held that once a moratorium is declared under the Insolvency and Bankruptcy Code, the customs authorities can only assess and quantify their dues; they cannot initiate recovery, sell goods or enforce any lien over the debtor's assets. The Code prevails over the Customs Act to this extent. The authorities must submit their claim to the resolution professional or liquidator like any other creditor.

What is the difference between GSTR-1 and GSTR-3B?
GSTR-1 is a detailed invoice-wise statement of your sales, filed by the 11th of the next month. It does not involve any tax payment but it feeds your customers' GSTR-2B for input tax credit. GSTR-3B is a self-declared summary return, due on the 20th, where you report total sales, claim input tax credit and pay the net tax in cash or through credit. I made a mistake in GSTR-3B. Can I revise it?
No, GSTR-3B cannot be revised once filed. The GST law allows corrections only through adjustments in the returns of subsequent tax periods. If you under-reported tax, pay the difference with 18 percent interest in the next GSTR-3B or through Form DRC-03. If you over-reported, adjust it in a later month within the time limits allowed. There is no outer time limit on issuing a debit note itself. Do I have to pay GST on my Adobe, Canva or AWS subscriptions billed from abroad?
If you are GST-registered and the foreign supplier has not charged Indian GST, yes. Services received from a supplier located outside India for business purposes are an import of services, taxable in your hands under reverse charge at 18 percent. What details must a GST tax invoice compulsorily contain?
Rule 46 of the CGST Rules prescribes the mandatory contents: your name, address and GSTIN; a consecutive serial number not exceeding sixteen characters, unique for the financial year; the date of issue; the recipient's name, address and GSTIN if registered; the HSN or SAC code; description, quantity and unit; total and taxable value; any discount; the rate and amount of CGST, SGST or IGST shown separately; place of supply with the state name for inter-state supplies; a declaration where tax is payable on reverse charge; and signature or digital signature of the supplier. Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. CBIC Circular 140/10/2020 settles the position: remuneration to a whole-time or executive director who is an employee, paid as salary with TDS under Section 192, is outside GST entirely as an employer-employee transaction.
