An exporter's IGST refund on exported goods was withheld because it had claimed duty drawback at the higher rate. In Special Civil Application No. 20126 of 2018, the Gujarat High Court held that the shipping bill itself is deemed a refund application under Rule 96, the circular relied on by the department could not override the rules, and the refund of IGST paid on exports cannot be denied on account of the drawback claim. The court directed payment of the withheld refund with interest, setting a widely followed precedent for exporters.
Why this matters: If your IGST export refunds are held up over drawback technicalities, this precedent — followed by the Madras High Court — supports recovery of the refund with interest.

The Board answered a set of service taxability questions arising from the 52nd GST Council meeting. Among them, it confirmed that District Mineral Foundation Trusts set up by State Governments qualify as Governmental Authorities and are therefore eligible for the exemptions available to such authorities. Global Reach Education Services Pvt Ltd — AAR West Bengal, ruling dated 21 March 2018, upheld by AAAR West Bengal, Order No. 01/WBAAAR/Appeal/2018, dated 24 July 2018 · 2018-03-21
The applicant promoted courses of foreign universities in India and recruited students for them, receiving commission in foreign exchange. It claimed the service was an export and therefore zero rated. The West Bengal Authority for Advance Ruling, affirmed on appeal, held that the applicant merely facilitates admission of students to the university and is an intermediary under Section 2(13) of the IGST Act. As the place of supply of an intermediary is the location of the supplier, the service is a domestic supply liable to GST.
What to do about it: Businesses earning foreign commission for facilitating a third party's supply should test the intermediary risk before treating receipts as zero-rated exports.
