After cases of integrated tax refunds obtained on the strength of fake invoices, CBIC issued a standard operating procedure for exporters whose refunds are suspended pending verification. The jurisdictional CGST formation is to verify the exporter's existence, the genuineness of the input tax credit claimed and the details in a prescribed verification report, and to complete the exercise within fourteen working days, after which the report goes to the Chief Commissioner and the refund is released if the verification is favourable.

TVH Lumbini Square Owners Association - AAR Tamil Nadu, Order No. 25/ARA/2019, dated 21 June 2019 · 2019-06-21

A residents welfare association collected monthly maintenance contributions from its members. The Authority held that where the contribution per member exceeds Rs. 7,500 a month, GST is payable on the entire contribution and not merely on the amount above Rs. 7,500. The Madras High Court subsequently held, in Greenwood Owners Association, that only the excess over Rs. 7,500 is taxable, and associations now follow that judicial position.

Notification No. 76/2018-Central Tax dated 31.12.2018 · 2018-12-31

This notification prescribed the due dates for FORM GSTR-3B and waived the late fee under section 47 for registered persons who failed to furnish GSTR-3B for the months from July 2017 to September 2018 by the due date, where the pending returns were furnished between 22 December 2018 and 31 March 2019. It also restated the capped late fee of Rs 25 per day, and Rs 10 per day for nil returns.

An ASMT-13 best judgment order was passed against me. Can it still be nullified by filing the return?
Yes, Section 62 contains a self-correcting mechanism. If you furnish the valid return within sixty days of service of the ASMT-13 assessment order, the order is deemed withdrawn automatically, though late fee and interest remain payable. The Finance Act 2023 added a further cushion effective 1 October 2023: even after the sixty days, you can file the return within an additional sixty days by paying an extra late fee of Rs.100 per day under the CGST Act, with a matching state levy, for each day beyond the first window, and the order still stands withdrawn. Beyond the full one hundred and twenty days, the estimated demand becomes enforceable, leaving appeal as the remedy.
I missed the deadline to reply to a GST notice. What are my options now?
Act immediately, because delay narrows your options. If no order has been passed yet, file a belated reply with a condonation request explaining the delay and appear at the personal hearing; officers frequently take late replies on record before adjudicating. If an ex parte order has already been issued, you can file an appeal in Form APL-01 within three months of the order, paying the mandatory pre-deposit of 10 percent of the disputed tax. How do I check whether any GST notices have been issued to my business?

What penalties does Section 122 of the CGST Act prescribe, and for which offences?
Section 122(1) lists twenty-one offences, including supplying without an invoice, issuing an invoice without supply, collecting tax but not depositing it beyond three months, failing to deduct or collect TDS or TCS, wrongly availing input tax credit and failing to register when liable. The penalty is Rs.10,000 or an amount equivalent to the tax evaded or credit wrongly taken, whichever is higher. For short payment of tax, Section 122(2) prescribes 10 percent of the tax or Rs.10,000, whichever is higher, in non-fraud cases, and a penalty equal to the tax or Rs.10,000, whichever is higher, where fraud is involved. An equal penalty applies under the SGST Act.
Can a compliance review actually prevent GST notices?
Largely, yes. Most notices arise from mismatches the portal detects automatically: GSTR-1 versus GSTR-3B tax differences, ITC claimed beyond GSTR-2B, e-way bill turnover gaps and unfiled returns. A periodic review catches these before the system does, so you can correct them through amendments in subsequent returns or a voluntary DRC-03 payment with interest, which under Section 73 attracts no penalty and no notice for the amount paid. What a review cannot prevent are genuine interpretation disputes, but even there it prepares your documentation in advance. I received Form DRC-07 after an adjudication order. What happens next?
DRC-07 is the summary of the demand created on the portal after the officer passes an order, and it makes the amount recoverable. You now have two lawful paths. What GST rate applies to a goods transport agency: 5 percent or 18 percent?
Both exist, depending on the option exercised. The default position is 5 percent payable by the specified recipient under reverse charge, with no input tax credit to the GTA. Alternatively, a GTA may opt to pay tax itself under forward charge, either at 5 percent without input tax credit or at the higher rate with full credit, which was revised from 12 percent to 18 percent with effect from 22 September 2025. The with-credit option suits transporters with large spends on vehicles and tyres. Once the forward charge option is exercised for a year, it applies to all consignments of that year.
What are the common types of GST notices a business can receive?
The frequent ones are: REG-03 seeking clarification on a registration application; GSTR-3A for non-filing of returns; ASMT-10 pointing out discrepancies found on scrutiny of returns; DRC-01A intimating an ascertained tax liability before formal proceedings; DRC-01, the show cause notice under Section 73 or 74; ADT-01 intimating a departmental audit; REG-17 proposing cancellation of registration; RFD-08 proposing rejection of a refund claim; and summons under Section 70. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. The Input Service Distributor mechanism distributes credit on third-party input services received at the head office but consumed by branches, such as an audit fee or software licence billed centrally; the ISD passes the credit itself through ISD invoices and GSTR-6, without charging tax again. Cross-charge applies where the head office performs a service for branches using its own resources; here the head office makes an outward supply, issues a tax invoice with tax, and the branch claims ITC. With ISD distribution mandatory for common third-party input services from 1 April 2025, businesses must now run both mechanisms side by side, each for its correct category.
Does buying from unregistered dealers attract reverse charge for everyone?
No. The general reverse charge on all unregistered purchases under Section 9(4) was never fully implemented and now applies only to notified classes, principally real estate. A promoter must procure at least eighty percent of inputs and input services from registered suppliers for a project; on any shortfall, the promoter pays 18 percent under RCM, and cement purchased from an unregistered dealer attracts RCM at the rate applicable to cement, 18 percent since the September 2025 rate rationalisation reduced it from 28 percent, irrespective of the eighty percent test. Transfer of development rights and long-term leases to promoters are also covered. An ordinary trader or service provider in Manali buying stationery from an unregistered shop has no Section 9(4) liability at all.
I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B. Instead, you pay tax every quarter through statement CMP-08, due by the 18th of the month following the quarter, and file one annual return, GSTR-4, by 30 June following the financial year. The scheme is available for turnover up to Rs.1.5 crore for goods, with a separate 6 percent scheme for service providers up to Rs.50 lakh. By when must I issue a tax invoice when I sell goods?
For goods, Section 31 requires the tax invoice to be issued before or at the time of removal of the goods, where the supply involves movement, or before or at the time of delivery or making the goods available in other cases. In simple terms, the invoice must travel with the goods; a lorry leaving your Manali godown without an invoice is exposed to detention even if the e-way bill exists. For continuous supplies of goods with successive statements or payments, the invoice must be issued when each statement is issued or each payment is received.
How many digits of the HSN code must I print on my tax invoices?
