CBIC clarified that maintenance charged by a resident welfare association is exempt where it does not exceed Rs 7,500 per member per month, a limit raised from Rs 5,000 with effect from 25 January 2018. An association is liable to register only if its annual turnover exceeds Rs 20 lakh and its charges exceed Rs 7,500. Where the limit is crossed, tax is payable on the entire amount and not merely the excess. A member owning two flats gets the limit separately for each, and the association can claim input tax credit.

Practical effect: Apartment associations across Chennai should test both the Rs 20 lakh turnover and the Rs 7,500 per-flat tests, and remember that crossing the limit taxes the whole amount.

The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.

What to do about it: Section 9(4) reverse charge on ordinary unregistered purchases never operated after 12 October 2017, which is a complete answer to demands raised on that footing for later periods.

A day before the change took effect, the Tax Research Unit issued FAQs explaining that the expression takes its meaning from the Legal Metrology Act, 2009 and covers commodities intended for retail sale in packs of up to twenty-five kilograms or twenty-five litres that must bear statutory declarations. A single package above that limit is not covered, nor are packs supplied to an industrial or institutional consumer. Loose sale from a large pack by a retailer does not attract the levy.

Why this matters: A fifty-kilogram rice bag sold as one package stays outside the levy, but the moment it is repacked into labelled retail bags of twenty-five kilograms or less, five per cent applies.

Before attending, reconstruct the facts, reconcile your returns and carry organised records of the transactions under inquiry. Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. Signing requires the emSigner utility running in the background, and the common failure to establish connection error means emSigner is not started, is blocked by the browser, or another application occupies its port. What is the difference between ISD and cross-charge, and when is each used?
They solve different problems. When you receive supplies liable to reverse charge from an unregistered supplier, Section 31(3)(f) requires you, the recipient, to issue an invoice on yourself, because the supplier cannot issue a tax invoice. You must also issue a payment voucher when paying the supplier. From 1 November 2024, Rule 47A prescribes a firm deadline: the self-invoice must be issued within thirty days of receiving the supply. This document is not a formality; the time limit for claiming the RCM credit is reckoned from the self-invoice, and its absence can cost you the credit besides inviting penalty. Maintain a monthly self-invoice series covering rent, freight, legal fees and similar unregistered-supplier heads.
I returned an advance because the deal was cancelled. What document do I issue?
It depends on how far the paperwork went. If you had issued only a receipt voucher and no tax invoice, you issue a refund voucher under Rule 51 when returning the advance, and the tax paid on that advance can be adjusted. If a tax invoice had already been issued, the cancellation is handled through a credit note under Section 34 instead. The refund voucher records the original receipt voucher reference, the amount refunded and the tax involved. I am a composition dealer. Which returns apply to me and when?
Composition taxpayers do not file GSTR-1 or GSTR-3B.
