Notification No. 02/2019-Central Tax dated 29.01.2019 · 2019-01-29
This notification appointed 1 February 2019 as the date on which the Central Goods and Services Tax (Amendment) Act, 2018 came into force. That amendment Act made several structural changes, including replacing the blanket reverse charge on purchases from unregistered persons under section 9(4) with a narrower provision applying only to notified classes of registered persons, permitting multiple registrations within a State for separate places of business, and widening the scope of eligible input tax credit.
Practical effect: For a Chennai business, 1 February 2019 is the date the unregistered-purchase reverse charge threat was permanently removed and separate registrations for multiple Chennai premises became possible.
Circular No. 179/11/2022-GST, dated 3 August 2022 · 2022-08-03
Implementing the 47th GST Council recommendations, CBIC clarified that an electrically operated vehicle attracts the concessional five per cent rate whether or not it is fitted with a battery pack at the time of supply, ending a dispute that had hurt manufacturers using battery-swapping models. The circular also addressed the classification of fly ash bricks and blocks, by-products of milling of pulses and dal such as chilka and khanda, treated sewage water, and nicotine polacrilex gum.
How we apply it: Electric vehicle sellers should not be forced into eighteen per cent merely because the battery is billed or leased separately, and this circular is the answer to such a notice.
51st GST Council Meeting (virtual mode, New Delhi) — 2 August 2023 · 2023-08-02
The 51st meeting recommended amendments to the CGST Act and IGST Act, including Schedule III, to tax supplies in casinos, horse racing and online gaming at 28 per cent. Valuation was fixed at the amount paid or payable to or deposited with the supplier by or on behalf of the player, excluding amounts staked out of winnings of previous games or bets, so the tax applies on entry deposits rather than on every bet. Suppliers of online money gaming located outside India were required to take a single simplified registration, failing which public access to their platforms can be blocked. The Council said the process of amending the Acts would be completed within two months, and the amendments were brought into force from 1 October 2023.
What it means for you: From 1 October 2023, gaming operators must pay 28 per cent on user deposits, and foreign platforms without Indian registration face blocking and enforcement.
