After the failed first attempt at rollout, this notification substituted rules 138, 138A, 138B, 138C and 138D of the CGST Rules with a redrafted set. The revised rules refined who must generate the e-way bill, introduced clearer treatment of transport by rail, air and vessel, addressed transfer of goods between conveyances and consolidated e-way bills, and rationalised the validity period and the list of exempt movements.
Practical effect: The e-way bill rules a Chennai business follows today are substantially the version substituted by this notification, so older commentary written before March 2018 can be misleading.
33rd GST Council Meeting, New Delhi — 20 and 24 February 2019 · 2019-02-24
To revive the residential real estate sector, the Council recommended an effective GST rate of five per cent without input tax credit on residential properties outside the affordable segment, and one per cent without input tax credit on affordable housing, with effect from 1 April 2019. The Council reasoned that buyers would get a fair price, that disputes about builders not passing on credit would become irrelevant, and that unutilised credit which used to become a project cost would be removed.
How we apply it: Flat buyers in Chennai pay one or five per cent on under-construction purchases, but the builder cannot claim input credit, so the tax is embedded in the price rather than shown as recoverable.

The Maharashtra appellate authority held that penal interest and cheque bounce charges collected by a finance company from borrowers who delayed instalments are consideration for tolerating an act and are liable to GST at 18 per cent. CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.
What it means for you: If you collect late payment penalties from customers, check whether the charge sits inside the main contract before deciding to levy GST on it.
