This circular amends and supplements the earlier warranty circular. It extends the treatment from replacement of parts to replacement of goods or their parts, so that a full product replacement under warranty is covered on the same basis, with no GST and no credit reversal. It also addresses the position where a distributor replaces goods out of its own stock and is later replenished by the manufacturer, and the treatment of extended warranty sold separately after the original supply.
What to do about it: Chennai dealers who swap out an entire defective product under warranty are now expressly covered, so no output tax or credit reversal is required.

Acting on the 45th GST Council recommendation, the Government raised the rate on solar power based devices, solar generators, photovoltaic cells and modules, wind operated electricity generators, biogas plants and waste-to-energy devices from five per cent to twelve per cent with effect from 1 October 2021. Combined with the 70:30 deeming rule, this pushed up the delivered cost of rooftop and utility scale solar projects and prompted a wave of contract repricing and change-of-rate disputes under Section 14.
Why this matters: Projects straddling 1 October 2021 must fix the rate using the time-of-supply rules in Section 14, since invoice date, payment date and supply date can point to different rates.
38th GST Council Meeting, New Delhi — 18 December 2019 · 2019-12-18
The Council waived late fee for taxpayers who furnished all pending statements of outward supplies in GSTR-1 for the tax periods from July 2017 to November 2019, provided they were filed by 10 January 2020. It also decided that e-way bill generation would be blocked for taxpayers who had not filed GSTR-1 for two tax periods, extending the blocking mechanism that already applied to GSTR-3B defaulters. Standard operating procedures were prescribed for officers dealing with non-filers, and Grievance Redressal Committees were set up at zonal and state level.
What it means for you: GSTR-1 default now carries its own e-way bill block, so filing GSTR-3B alone is not enough to keep despatches moving.
