CBIC Instruction No. 04/2025-GST · 2025-05-02
To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office. Applicants aggrieved by improper queries, unjustified rejection or delay may write to that address with the application reference number; the zone must examine the grievance, take corrective action and report the disposal to the Directorate General of GST periodically.
What it means for you: A registration rejected on flimsy grounds need not go straight to appeal; the zonal grievance email often gets the application reopened far faster.
Notification No. 09/2017-Integrated Tax (Rate) dated 28.06.2017 · 2017-06-28
The integrated tax equivalent of the services exemption list. Besides mirroring the domestic exemptions, it carries entries that only arise in a cross-border context, such as services received from a provider located in a non-taxable territory by specified recipients, and certain services relating to transportation of goods to a place outside India. Courts have relied on its Entry 13, covering renting of residential dwellings for use as residence, when deciding hostel and long-stay accommodation disputes.
What it means for you: Chennai exporters and importers of services should check this notification before assuming an inter-State or cross-border service is taxable.
Bharat Sanchar Nigam Ltd v. Union of India — Supreme Court, (2006) 3 SCC 1, judgment dated 02-03-2006 · 2006-03-02
The Supreme Court held that the same transaction may have a goods aspect and a service aspect, and different legislatures may tax different aspects, but the same element cannot be taxed twice. A composite contract cannot be split into goods and services except in the cases specifically permitted by Article 366(29A), such as works contracts and catering. The dominant nature test was applied to decide the character of the contract.
What it means for you: Chennai businesses with bundled offerings should determine the dominant character of the supply, since that decides classification and rate under GST.
