GSTN Advisory dated 14 November 2023 — Form GST DRC-01C under Rule 88D of the CGST Rules · 2023-11-14
Where the input tax credit availed in GSTR-3B exceeds the credit available in GSTR-2B by more than the prescribed limit, the portal issues an intimation in Form GST DRC-01C. The taxpayer must reverse the excess with interest through DRC-03 or file a reply in Part B giving reasons, within seven days. If neither is done, the filing of the next GSTR-1 or Invoice Furnishing Facility statement is blocked.
Why this matters: Match your credit register against GSTR-2B before filing GSTR-3B, since an unexplained excess now stops your outward return.
14th GST Council Meeting, Srinagar — 18-19 May 2017 (PIB Release ID 1490274) · 2017-05-18
The Council completed the fitment exercise for goods and broadly approved GST rates at nil, five, twelve, eighteen and twenty-eight per cent across the tariff, along with the rates of GST compensation cess to be levied on specified goods. The chapter-wise, rate-wise schedule dated 18 May 2017 was published on the CBEC website immediately after the meeting, subject to further vetting, and formed the basis of the rate notifications issued for the 1 July 2017 rollout.
Practical effect: The original HSN-wise rate schedule for your products dates from this meeting; classification disputes often turn on how an item was fitted here.
Circular No. 141/11/2020-GST dated 24 June 2020 · 2020-06-24
This circular explained Notifications 51, 52 and 53 of 2020-Central Tax issued on the recommendations of the 40th GST Council meeting. The rate of interest was reduced from eighteen to nine per cent for specified periods, and for small taxpayers it was staggered, with nil interest up to a specified date and nine per cent thereafter until 30 September 2020. The conditional waiver of late fee on GSTR-3B was given revised dates for February to April 2020 and extended to May, June and July 2020 for small taxpayers, and late fee on delayed GSTR-1 was waived if filed by the specified dates. Circular No. 136/06/2020-GST was modified to this extent.
Practical effect: The late fee waiver here is conditional: if the GSTR-3B was not filed by the notified date, late fee runs from the original due date, so the actual filing date decides whether any waiver survives.
