Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.

The club collected membership subscriptions and admission fees which were spent on meetings, administration and communication, with no facility or benefit supplied to members in return. The Maharashtra Appellate Authority for Advance Ruling held that the collections merely defray shared expenses, that there is no supply of goods or services to members, and that the amounts are therefore not consideration liable to tax.
Practical effect: Chennai associations should note that Section 7(1)(aa), inserted with retrospective effect from 1 July 2017, now treats club to member supplies as taxable, so this reasoning no longer holds.

The department attached the bank account of a company that was not itself under investigation, because an inquiry was running against another taxpayer whose transactions touched it. The High Court held that Section 83 permits provisional attachment only where proceedings under Sections 62, 63, 64, 67, 73 or 74 are pending against that very taxable person. A summons issued to a third party under Section 70 does not open the door to attaching that party's bank account. The attachment was quashed.
Why this matters: If your account is frozen because a customer or supplier is under investigation, check first whether any specified proceeding is actually pending against your own GSTIN.
