The approved design provided for State-wise single registration, a single State-wise return covering intra-State, inter-State and export supplies, registration exemption below Rs 20 lakh turnover (Rs 10 lakh in Special Category States), a composition scheme up to Rs 50 lakh, broad input tax credit entitlement, and cross-utilisation of credit between CGST, SGST, UTGST and IGST in a prescribed order.

The Supreme Court dismissed the department's appeal and confirmed that where a holding company issues a corporate guarantee for its group companies without charging any consideration, no service tax is leviable. A taxable service requires consideration, and where none flows, the charge fails. Under GST the position has since been altered by a specific valuation rule for corporate guarantees between related persons, so the current position must be checked separately.

Acting on the GST Council's decision at its 23rd meeting in Guwahati, this notification restructured the rate on restaurant, eating joint, mess and canteen services. From 15 November 2017 the rate became 5 per cent with the express condition that no input tax credit on goods and services used in supplying the service may be taken. Restaurants located in hotels where the declared tariff of any unit of accommodation was seven thousand five hundred rupees or more continued at 18 per cent with full input tax credit.
