Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
Practical effect: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.

The Council recommended withdrawing the exemption on hotel accommodation priced up to one thousand rupees per unit per day and taxing it at 12 per cent, and taxing room rent charged by a hospital, other than intensive care and similar critical care units, where the charge exceeds five thousand rupees per day per patient, at 5 per cent without input tax credit. It also recommended withdrawing the small-consignment exemptions for goods transport agencies and giving transporters a forward-charge option. The changes took effect from 18 July 2022.
What to do about it: Chennai lodges charging under one thousand rupees a night and hospitals with deluxe rooms above five thousand rupees a day both acquired new GST liabilities from 18 July 2022.
Notification No. 35/2020-Central Tax · 2020-04-03
Using the newly inserted Section 168A, CBIC extended to 30 June 2020 every action, whether by a taxpayer or an officer, whose due date fell between 20 March 2020 and 29 June 2020. This covered completion of proceedings, passing of orders, issue of notices, filing of appeals, replies and applications. Return filing, payment of tax and e-way bill obligations were kept outside the extension, being dealt with by separate notifications. The window was later extended further by subsequent notifications.
Practical effect: This is the starting point of the whole COVID limitation chain and is the first thing to check when a Chennai business faces a demand said to be time-barred or an appeal said to be late.
