The liability to pay tax on reverse charge basis on supplies received from unregistered persons, already suspended at the 22nd meeting until 31 March 2018, was deferred further to 30 June 2018. A Group of Ministers was appointed to examine the modalities of implementation so that no inconvenience would be caused to trade and industry. The provision was ultimately never revived in its original form and was replaced by a narrower, notified-goods version at the 28th meeting.

Why this matters: Section 9(4) reverse charge on ordinary unregistered purchases never operated after 12 October 2017, which is a complete answer to demands raised on that footing for later periods.

Reversing the single judge, the Division Bench held that accumulated CENVAT credit of Education Cess, Secondary and Higher Education Cess and Krishi Kalyan Cess cannot be transitioned into the GST regime under Section 140 of the CGST Act. These cesses had been abolished before GST began and were never notified as eligible duties, so the balances had become dead claims that cannot be set off against output GST.

Practical effect: If your TRAN-1 carried forward old cess balances, expect a demand — this Madras High Court ruling binds Tamil Nadu businesses and there is no entitlement to that credit.

CBIC clarified that under Rule 88B(3), interest under Section 50(3) arises only where wrongly availed input tax credit has actually been utilised. Credit is treated as utilised only if the total balance in the electronic credit ledger falls below the amount of the wrongly availed credit. The total of the IGST, CGST and SGST balances is to be seen together, not head-wise, so a taxpayer who maintained a sufficient overall balance until reversal pays no interest.

How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. How do I check whether any GST notices have been issued to my business?
Log in to gst.gov.in and go to Services, then User Services, then View Notices and Orders for registration-related communications. If you charged a higher rate than applicable, the excess tax collected must still be paid to the government under Section 76, or you can issue credit notes to customers within the permitted time and adjust the tax. If you charged a lower rate, the shortfall is your liability: pay the differential tax with interest at 18 percent per annum through your returns or Form DRC-03, and issue debit notes to registered buyers so they can take the additional credit. What is the place of supply for freight and courier charges on goods?
For transportation of goods, including by courier, Section 12(8) fixes the place of supply as the location of the recipient where the recipient is registered. Where the recipient is unregistered, it is the location where the goods are handed over for transportation.
