Where a resolution plan is approved by the adjudicating authority under the Insolvency and Bankruptcy Code and the government's claim is scaled down, the tax department cannot continue to pursue the original demand. The Board directed officers to give effect to the approved plan by issuing an intimation in FORM GST DRC-25 under Rule 161, reducing the demand in the recovery records to the amount admitted in the plan, and to close recovery proceedings for the balance.
Practical effect: If a Chennai company has come out of insolvency, insist on a DRC-25 intimation so that the old demand stops appearing in the recovery register and blocking registration or refunds.

An adverse order was passed after the taxpayer marked 'No' in the personal hearing column of the reply form. The High Court held that under Section 75(4) an opportunity of personal hearing must be granted wherever a request is received or where an adverse decision is contemplated. Since the order was adverse, a hearing was mandatory irrespective of whether it was requested. The order was quashed and the matter remitted for a fresh decision after hearing.
Why this matters: An assessment or demand order passed without a personal hearing is liable to be set aside — always check the hearing record before deciding how to challenge an order.

Invoking Section 168A once more, CBIC extended compliances whose due dates fell between 15 April 2021 and 29 June 2021 to 30 June 2021. The first notification of 1 May 2021 set the outer date at 31 May 2021 and the second of 1 June 2021 moved it to 30 June 2021. The relief covered completion of proceedings, passing of orders, issue of notices, filing of appeals, replies and applications, but excluded return filing and tax payment which were dealt with separately.
Practical effect: Any appeal, reply or refund application that fell due during the second wave gets the benefit of this extension, which is worth checking before conceding that a claim is time-barred.
